As part of our cooperative arrangements, we also handle international and major insolvency proceedings. The aim of our practice in this area is to maintain value with an eye to optimum satisfaction of creditors as well as safeguarding employees’ rights and jobs. Alongside insolvency administration, we advise both debtors and creditors in all matters of insolvency and bankruptcy law, including reorganization and restructuring, safeguarding of creditors’ rights through drafting of insolvency-proof items of security, and implementation of moratoria. |
We assist entrepreneurs throughout insolvency proceedings, all the way up to coaching for reestablishment of a business. We represent creditors in assemblies and on committees as well as in all questions of assertion of liability claims and equity substitution. We specialize in asserting claims arising from commission of offenses, even after discharge of residual debts (Restschuldbefreiung). In the context of transferred reorganization (übertragende Sanierung), we design solutions to cushion the impact and represent investors in insolvency plan procedures (Insolvenzplanverfahren) and asset deals. By implementing insolvency plan procedures (Insolvenzplanverfahren), we maintain companies’ existence. We analyze the suitability of the matter for an insolvency plan, draft the plan, and help with turnaround financing. |
